Firm Obtains Significant Decision in Property Tax Appeal Affecting Condominiums

Richard E. Castiglioni and Jonathan J. Kelson recently obtained an important ruling from the Connecticut Superior Court on behalf of their clients, a condominium association and the condominium’s 400 unit owners, in connection with a tax appeal concerning the revaluation of the units. Mr. Castiglioni and Mr. Kelson requested that the court permit the condominium association to intervene in and prosecute the tax appeal on behalf of the condominium’s 400 unit owners pursuant to Connecticut’s condominium statute, the Common Interest Ownership Act (CIOA). The court, over the defendant city’s objection, agreed with Mr. Castiglioni and Mr. Kelson’s interpretation of CIOA and the governing case law and granted the association’s request to intervene. This is a significant decision in the areas of condominium law and tax appeals that will surely affect how condominium tax appeals are filed, litigated and ultimately tried.
