Foreclosures and Loan Workouts

Diserio Martin O'Connor & Castiglioni LLP’s attorneys have the capability to handle all aspects of problem loans, including workout and restructuring, foreclosure, securing deficiency judgments through the prejudgment remedy process, and, when necessary, by obtaining relief from stay in the bankruptcy courts in Connecticut as well as the Southern and Eastern Districts of New York.

During the banking crisis in the early 1990’s, we handled over $250 million of problem loans for the FDIC and its servicers in the Connecticut state, federal and bankruptcy courts. We also handle appeals in the state and federal courts, and we have successfully represented our lender clients in several appeals involving foreclosure law.

We have experience involving all commercial real estate classes, including hotels, multifamily housing (both single-owner and cooperative), office and retail. Our intimate knowledge of the real estate market enables us to address the many complex issues that come into play in distressed real estate situations. Our litigators and transactional lawyers often work together with our clients to craft the best approach to resolving troubled real estate investments.
